Terms of Service

Last updated: July 2026

These Terms of Service govern your use of the TMS Indoor Air Quality website and the services we provide. By using our website or engaging our services, you agree to these terms.

Services

TMS Indoor Air Quality provides residential indoor air quality services including radon mitigation, dryer vent cleaning, crawlspace encapsulation, mold remediation, sump pump service, and ventilation solutions. All services are performed by licensed and certified technicians in accordance with applicable state regulations and industry standards.

Appointments and Scheduling

Appointments may be scheduled via our online booking system, by phone, or by email. We will confirm your appointment by phone or email. Cancellations should be made at least 24 hours in advance. We reserve the right to reschedule due to weather or other circumstances beyond our control.

Pricing and Payment

Pricing is provided upfront before any work begins. Final pricing is confirmed on-site after assessment. We do not charge hidden fees. Payment is due upon completion of service. We accept cash, check, and major credit cards.

Warranties

Warranties vary by service:

  • Radon mitigation systems: 5-year warranty on installation and components
  • Dryer vent cleaning: 90-day warranty
  • Crawlspace encapsulation: Limited lifetime warranty on defects and taped seams
  • Mold remediation: Lifetime warranty on treated areas

Warranties are void if the property is modified in a way that affects the treated system, or if damage occurs due to events outside our control (flooding, structural failure, pest damage, etc.).

Limitation of Liability

Our liability is limited to the cost of the services provided. We are not responsible for pre-existing conditions, damage caused by factors outside our control, or consequential damages. Radon mitigation does not guarantee radon levels will remain below any specific threshold permanently, as radon levels can fluctuate based on external factors including soil conditions and barometric pressure.

Access and Property

You are responsible for ensuring our technicians have safe, unobstructed access to all areas where work is to be performed. You represent that you have the legal authority to authorize work on the property.

Governing Law

These Terms are governed by the laws of the Commonwealth of Massachusetts. Any disputes arising from these Terms or our services shall be resolved in the courts of Hampden County, Massachusetts.
